Mediation is an alternative dispute resolution (ADR) process of voluntary participation in nature that aims at building consensus and agreement through a neutral third party acting as a facilitator or catalyst for effective communication, issues clarification and options generation. There are many success stories of resolving disputes by mediation without the need of going to court. The disputants not only save their tremendous amount of time and money on litigation, but also the precious relationship between them.

After undergoing mediation training, students will:

a.   have better inter-personal skills when dealing with people internally and externally;
b.   help promote a friendlier and more harmonious corporate culture in their workplace;
c.   be more competent in negotiating a good deal when conducting business negotiations for and on behalf of the organization;
d.   apply the mediation skills learnt to resolve internal and external disputes arising from his/her course of work in a more efficient and effective manner;
e.   acquire better management skills to tackle and overcome any corporate crisis (e.g. employment dispute); and
f.   save the organization from expending substantial amount of time, efforts and resources to resolving disputes and avoid the time consuming and costly methods of resolving disputes such as court proceedings or power struggles.

Upon successful completion of this subject, students will be able to
‧   understand the fundamental framework on how mediation works, including its basic principles, procedures and techniques, and the major legal issues behind the scene.
‧   conduct general-purpose mediations, such as community or commercial mediations, aiming at a win-win settlement to the benefit of and acceptable to both the parties in dispute.
